1. Acceptance of Terms
By accessing or using Treyboat (operated by Triple S & M LLC, a Florida limited liability company, hereinafter "Treyboat," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you must not use the platform. Your continued use of the platform after any modification to these Terms constitutes acceptance of the revised Terms.
2. Platform Description — Marketplace Intermediary
Treyboat is a technology marketplace platform, not a boat operator, transportation provider, maritime authority, or party to any charter agreement.
Treyboat provides software tools that allow independent boat owners ("Owners") to list their vessels and connect with individuals seeking private charter experiences ("Guests"). All charter agreements are entered into solely and directly between the Owner and the Guest. Treyboat is not involved in, and has no control over, the conduct of Owners, Guests, or the operation of any vessel.
Owners are independent operators and are not employees, agents, contractors, or representatives of Treyboat. Treyboat does not inspect, certify, endorse, or guarantee any vessel, Owner, Guest, captain, or charter activity listed or facilitated through the platform.
3. Assumption of Risk — Guests
IMPORTANT — PLEASE READ CAREFULLY BEFORE BOOKING
Boating and maritime activities involve inherent risks including, but not limited to: adverse weather conditions, mechanical failure, capsizing, collision, fire, falling overboard, carbon monoxide exposure, personal injury, permanent disability, and death.
By completing a booking on Treyboat, you acknowledge and agree that:
- You are voluntarily participating in a boating activity and assume all risks associated with such activity, including the risks described above.
- You are responsible for assessing your own fitness and the fitness of all persons in your party to participate in the charter.
- You will comply with all instructions given by the captain and crew at all times.
- Treyboat has no control over, and expressly disclaims all liability for, any event occurring before, during, or after the charter, including events resulting from the condition of the vessel, the actions of the Owner, captain, crew, or any other guest.
- Your sole recourse for any claim arising from a charter is against the Owner of the vessel, not Treyboat.
This assumption of risk and release of liability is a material condition of your use of the platform. If you are not willing to assume these risks, do not complete a booking.
4. Owner Responsibilities & Indemnification
By listing a vessel on Treyboat, each Owner agrees and represents that:
- Their vessel complies with all applicable federal (USCG), Florida state, and local maritime laws, safety regulations, and inspection requirements.
- The vessel is seaworthy and fit for the charter activities offered.
- All captains and crew hold valid licenses and certifications required by applicable law.
- They maintain, at their sole cost, adequate marine liability insurance, P&I (Protection and Indemnity) coverage, and any other insurance required by applicable law or prudent maritime practice. Treyboat does not require proof of insurance but strongly recommends it. The Owner is solely responsible for ensuring adequate coverage. Treyboat accepts no liability for losses that would have been covered by insurance the Owner failed to obtain or maintain.
- They are the sole operator responsible for the safety of all persons aboard during a charter.
Indemnification.
Each Owner agrees to indemnify, defend, and hold harmless Treyboat, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) the Owner's vessel, charter activities, or any incident occurring during a charter; (b) the Owner's breach of these Terms; (c) the Owner's violation of any applicable law; or (d) any claim by a Guest or third party arising from a charter facilitated through the platform.
5. Limitation of Liability & Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- TREYBOAT IS NOT LIABLE FOR ANY PERSONAL INJURY, DEATH, PROPERTY DAMAGE, LOSS OF LIFE, OR ANY OTHER LOSS OR DAMAGE OF ANY NATURE ARISING FROM OR IN CONNECTION WITH ANY CHARTER FACILITATED THROUGH THE PLATFORM, WHETHER CAUSED BY THE NEGLIGENCE OF AN OWNER, GUEST, CAPTAIN, CREW MEMBER, OR ANY OTHER PARTY.
- TREYBOAT MAKES NO WARRANTY, EXPRESS OR IMPLIED, REGARDING THE SEAWORTHINESS OF ANY VESSEL, THE QUALIFICATIONS OF ANY CAPTAIN OR CREW, OR THE SAFETY OF ANY CHARTER ACTIVITY.
- THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
- TREYBOAT'S TOTAL AGGREGATE LIABILITY TO ANY USER FOR ANY CLAIM ARISING FROM USE OF THE PLATFORM SHALL NOT EXCEED THE TOTAL SERVICE FEES ACTUALLY PAID BY THAT USER TO TREYBOAT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain types of damages. In such jurisdictions, Treyboat's liability is limited to the maximum extent permitted by law.
6. Service Fees
Treyboat charges the following fees on each confirmed booking:
- Guest service fee: 8% of the total charter price, charged to the guest at checkout.
- Owner platform fee: 8% of the total charter price, deducted from the owner's payout.
- Payment processing: Approximately 3% Stripe processing fee, included in the above.
All service fees are non-refundable regardless of cancellation reason, including force majeure events, weather cancellations, or any circumstances beyond Treyboat's control.
7. Payment & Deposits
Standard booking (Option A): A deposit of 40% of the total charter price plus the guest service fee is charged via Stripe at time of booking. The remaining 60% is paid directly to the Owner in cash or Zelle on the day of the charter.
Instant Book (Option B): 100% of the charter price plus a reduced guest service fee (6%) is charged via Stripe at time of booking. No cash payment required on the day.
Payments are processed securely via Stripe. Owner payouts are transferred via Stripe Connect within 2–3 business days of charter completion, or same-day for an additional fee.
8. Cancellation Policy — Guests
Guest cancellations are subject to the following retention policy. The guest service fee (8%) is never refunded.

Refunds are processed to the original payment method within 5–10 business days. For Option A bookings, the refund cannot exceed the deposit amount charged via Stripe.

9. Cancellation Policy — Owners
If an Owner cancels a confirmed booking, the Guest receives a Treyboat credit equal to the Owner penalty percentage:
- More than 30 days: 5% penalty
- 8–30 days: 15% penalty + profile warning (30 days)
- 2–7 days: 25% penalty + "Recent cancellations" badge (90 days)
- Less than 48 hours: 50% penalty + badge (180 days) + 7-day booking suspension
- No-show: 100% penalty + indefinite suspension pending review
10. Captain & Crew
Under Florida maritime law, guests have the right to choose their captain freely. Captain selection is recorded with a timestamp and IP address. Treyboat is not liable for the conduct, qualifications, or actions of any captain or crew member during a charter. Owners are solely responsible for ensuring any captain they engage holds all licenses and certifications required by applicable federal and state law.
11. Vessel Insurance
Treyboat strongly recommends that all Owners maintain adequate marine liability insurance, P&I coverage, and hull insurance for their vessels. However, Treyboat does not require proof of insurance as a condition of listing and is not responsible for verifying the existence or adequacy of any insurance policy. The Owner is solely and exclusively responsible for all decisions regarding insurance coverage. Treyboat shall have no liability for any uninsured loss or damage of any kind.
12. Dispute Resolution & Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or use of the platform shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida. You waive any objection to jurisdiction or venue in such courts.
For disputes between Owners and Guests arising from a charter, Treyboat may, at its sole discretion, offer mediation assistance but has no obligation to do so and is not a party to any such dispute.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining Terms will remain in full force and effect.
14. Changes to Terms
We may update these Terms at any time by posting the revised version on this page with an updated "Last updated" date. Your continued use of the platform after any such changes constitutes your acceptance of the new Terms.
